Any such contract will be deemed to have been concluded in England, UK, any such contract will be interpreted, construed and enforced in all respects in accordance with English Law. The customer and Fabric Heaven irrevocably submit to the non-exclusive jurisdiction of the English Courts.

Ownership

Is transferred to the customer upon receipt of payment in full.

Returns Policy

We want you to feel confident about shopping from fabric Heaven. If you have a problem, or are unhappy with your purchase, then we will do everything we can to put the matter right.

Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any item within seven days of delivery. You should be aware that if you cancel your order once the order has been despatched, we will not refund the postage and packing costs.

You should be aware that once we begin the delivery process, you will not be able to cancel any contract you have with us for services carried out by us (for example, postage and packing). As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item.

If you wish to return an item please re-package the goods securely and send them back to us within seven working days of the date the item was delivered to you.

For your protection we recommend that you use a recorded delivery service for returns, as we will not accept any responsibility for goods lost in transit.

If you are returning goods for reasons other than damage or defects, we will be happy to refund you for the returned items (excluding postage and packing), providing they are returned within seven working days of receipt, in re-sellable condition and in their original packaging.

Fabrics sold to you as seconds or substandard cannot be returned under any circumstances. Faults must be notified to the company within 7 days of receipt either by telephone, fax, e-mail or post. No goods are to be returned until this notification is made (a unique returns number will be issued to you). Fabric Heaven will not accept returns due to the customer changing their mind, or ordering in error.

Due to variances in dye lots, no responsibility is accepted where additional fabric is purchased with the purpose to match with previously purchased fabrics, or where you have received a sample. Shades can differ between dye lots and fabric rolls. Please Note: Because you are viewing swatches on a computer screen, the colours and textures may not be a true representation and samples should be obtained to ensure fabric is what you are seeking.

• Please ensure that you are satisfied with the fabrics you are placing the order for.
• We advise customers to order samples of fabrics prior to ordering any fabrics.
• Please note some fabrics can shrink during washing, dry cleaning, Ironing, etc. care must be taken.
• Please note that some fabrics can lose colour during washing, dry cleaning, and if left in direct sunlight.
• Every order will be carefully dealt with.
• All fabrics are carefully examined prior to despatch.
• Availability of some items and their shades cannot always be guaranteed.
• Your card will not be charged until your order is ready for despatch.
• Postage and packaging charges for fabric samples will be for mainland UK only.
• Postage and packaging charge for fabric orders will be for mainland UK only.
• We only ship to mainland UK, all shipments to overseas will need to be arranged and a shipping charged worked out before you place an order, any orders that don't meet this criteria will not be despatched and you will be refunded the full amount you have been charged.
• No claim will be entertained once fabric has been cut or used in any way.
• No refunds will be given on postage and packaging.

• Fabric purchases must be made in full metre increments. The minimum fabric purchase is 50 cms.
• Fabric swatches are available at the cost indicated in the relevant section. These swatches are not returnable, however, their cost will be deducted from the value of your order when a firm order is placed.
• We aim to deliver goods within 2 working days by Royal Mail First class post or a recognised courier service, however, please allow up to 7 to 14 days for both sample and fabric delivery. Fabrics not in stock can take up to 6 weeks for delivery, in extreme situations.
• For orders received before midday Monday to Thursday we aim to despatch on the same day for next day delivery. For orders placed before midday on Friday we aim to despatch the same day for Monday delivery. Subject to stock availablility.
• All orders received on Friday after midday will be despatched on Monday subject to stock availability.
